Global Legal plays an important role in protecting the Group’s reputation by helping to future-proof the organisation through robust legal risk and issue advisory. Responsible for providing comprehensive legal advice to senior management and all global businesses and functions, the team offers a diverse range of legal skills, jurisdictional experience and practice specialisms across all countries and territories in which our businesses operate.

We are currently seeking a high calibre professional to join our team as a Senior Legal Counsel, Competition Law.

Principal Responsibilities

Purpose of the Job

Competition law is a material risk for the HSBC Group globally and in Asia Pacific.  The purpose of the role is primarily support the Global Business Lines and Global Functions in Hong Kong and the rest of Asia Pacific on competition law issues and also support the wider team to:

·  Identify, advise on and support the management of competition law issues across markets in Asia Pacific
·  Ensure the provision of robust, balanced and forward-looking expert legal advice and proactive guidance on competition law issues to internal clients
·  Support the bank’s M&A transactions from the perspective of ensuring the risk of breach of competition law is appropriately mitigated
·  assist with the management of competition regulatory or internal investigations
·  Formulate responses to regulatory consultations or call of inputs to advance HSBC’s agenda or mitigate potential risks to HSBC’s businesses
·  Identify and capture internal and external lessons learned in relation to competition law, ensuring that experience and actionable insights are shared with the Asia Pacific region and opportunities are taken to equip the Group with forward-looking guidance
·  Actively participate in Group competition law practice group

Expectations of jobholder

·  Providing advice that strikes an appropriate balance between management / mitigation of legal risk and business efficacy
·  Escalating issues where necessary in order to ensure “the right thing” gets done
·  Prioritising time/focus and adapting workstyle to meet varied workloads
·  Engaging effectively with colleagues, through team-working and influencing skills, including at senior executive levels to help with the ‘risk steward oversight’ of competition risk mitigation measures and to manage key issues
·  Translating complex legal principles into the context of HSBC’s businesses.  Distilling and communicating complex ideas in an understandable manner
·  Adapting communication style and content to appropriately address management level of the audience, from senior management down
·  Navigating a large and complex organization, using personal networks and other skills as required.
·  Maintaining a regional focus on risk mitigation for Business Lines and Functions within Asia Pacific whilst managing a number of current issues in some jurisdictions
·  Providing legal services in a cost-effective manner

Requirements

·  Qualified lawyer of any seniority will be considered, but it is expected that a successful candidate will have with at least 3 years’ experience of advising on competition law issues (either in private practice, in house or at a regulator)
·  Experience of a broad spectrum of competition law concepts including behavioural issues (horizontal and vertical agreements and abuse of dominance) and investigation management.  Some M&A-related experience would be preferred
·  Strong technical legal skills and in-depth knowledge of competition law in a well-established regime. 
·  Solid judgment and ability to evaluate risk in a commercially focused way
·  Demonstrable ability to analyse the competition law implications of business proposals with relatively little supervision, including problem-solving ability
·  Strength in handling multiple matters concurrently and identifying the crux of the issue quickly
·  Excellent verbal and written communication skills, including ability to translate legal issues into easy to understand briefings
·  Demonstrably strong interpersonal skills including in particular team-working and influencing skills.
·  In-house experience will be an advantage
