Job Purpose:
To manage, direct and leverage specific designated patent and related legal activities within Sandoz to support the Global BD&L (Business Development & Licensing) Function.
Major Accountabilities :
- Directing and advising client on patent and related IP issues for designated products for Global, Regional and Local BD&L (Business Development & Licensing) functions.
- Conducting freedom-to-operate reviews and risk assessments of generic products from third party suppliers in an efficient manner and to a high standard.
- Directing and advising client on patentability, validity and infringement issues relating to European and/or national law and case law.
- Being aware of global pharmaceutical patent litigation strategies from a generic perspective, and providing support for execution of strategies by collaborating with patent litigation colleagues.
- Advising on drafting of intellectual property and litigation aspects of commercial agreements for licensing and supply of generic products.
- Staying up-to-date on developments in patent law, regulatory data exclusivity, SPC, and competition law, and advising where appropriate in conjunction with patent litigation and legal colleagues.
- Seeking and driving forward product opportunities for the business, in areas of weakness of patent protection, and clearly communicating advantages to the business.
- Continuously informing supervisor about activities and seeking support and approval as necessary.
- Commercial awareness, involving understanding the relationship between IP and product lifecycles of innovator and generic pharmaceutical products.
- Proactive knowledge sharing within Global Litigation Transactions & Launch team, the wider Global IP team, Global BD&L team and Legal BD&L team.
- Authorized by law to represent Sandoz affiliates as professional representative in all proceedings taking place at the European Patent Office and/ or the Boards of Appeal as a consequence of being qualified as European patent attorney (Art. 134 EPC) and/or
- Authorized by law to represent all national IP rights like patents, trade mark, utility models, design models, topographies, etc. at a National Patent Office and to represent all Sandoz affiliates at a national court in certain IP- related proceedings as a consequence of being qualified as a national patent attorney
Desired profile
Education:
Technical degree (B.Sc. or higher) in relevant subject (Chemistry, Biochemistry or Biology) and:
Europe: Admission to practice as a National and/or European Patent Attorney
; USA: Law degree (J.D. or L.L.B.) and admission to practice as a US Registered Patent Attorney
Languages:
English and another language desirable
Experience:
More than 3 years experience in a patent law firm and/or in an industry patent department.
