Job Scope
This position manages the day-to-day functions related to US and Canadian Benefits Compliance: This position assists with efforts to ensure that U.S. and Canadian benefit plans are in full compliance with federal, state and provincial laws. This includes, but is not limited to, ensuring all IRS, Department of Labor , any required state and Canadian government agency disclosure and notification requirements are met in a complete and timely manner to avoid penalties and fines associated with late, incomplete or missing reports or information.
Job Responsibilities & Percentage of Time (%)
1. Plan Documents: This position manages the development, revision, distribution, and storage of Summary plan documents for all US and Canadian benefit plans. The individual will be responsible for the development and ongoing supervision of the SPD process and workflow. In addition, this position is responsible for incorporating changes to state, federal and provincial laws into benefits programs and plan documents. (30%)
2. Audit Assistance: This position provides assistance with activities associated with the ERISA plan audits and assists, as needed, on other audits (either internal or external) in a proficient, timely and responsive manner ensuring that all information is provided to auditors by their requested due dates and that the operation of the benefit plans is conveyed accurately and in the most favorable light as possible. (5%)
3. As part of the ERISA audits, this position assists with efforts related to Form 11-K and 5500 filings as well as ensuring that the benefit plans’ Summary Annual Reports and Annual Funding Notices are communicated on a timely basis. Based on audit results and directives, this position assists with efforts to ensure that corrective actions are implemented from both a systems and work flow perspective. (10%)
4. This position assists with efforts to ensure that all required non-discrimination tests and recommends corrective action to department management in the event that test results are projected to fail. This position may assist with communications, such as Benefits Alerts regarding benefits compliance updates. This position may also assist with all other required benefits compliance tests (e.g., Determination of Key Employees under 409A) that must be performed in accordance with state, federal and provincial regulations. (7%)
5. Appeals: This position manages the ERISA appeals process for both voluntary and administrative committee appeals from start to finish and ensures a comprehensive understanding of the underlying issues that have given rise to the appeal. For each appeal, this position may be responsible for all correspondence with the appealing participant to ensure that the appeal has been resolved by 30 days after Mondelez has been notified of the initial appeal. This position also serves as Secretary to the Administrative Committee and manages all appeals that are presented to this committee. (8%)
6. This position assists with the monitoring of significant benefits-related legislation within the U.S. and Canada. (5%)
7. This position serves as a benefits compliance liaison with other benefits professionals and other departments in the company. For example, this position works with the company’s internal legal counsel to determine compliance requirements with respect to existing, new or future laws that could impact the company’s benefit plans. This position also provides compliance support, as needed, to the Shared Services Center in addressing or solving complicated or unusual circumstances encountered while administering the benefit plans. (10%)
8. This position assists with the process for making required payments to the Pension Benefit Guarantee Corporation (PBGC). (5%)
9. This position assists with compliance with the Health Insurance Portability and Accountability Act (HIPAA) to ensure compliance with all aspects of the Act including the existence of applicable Business Associate agreements for all applicable vendors. (5%)
10. This position assists with QDRO (Qualified Domestic Relations Order) process with the company’s vendor to ensure the process is working effectively and efficiently and that plan participants and their legal counsel are able to obtain the plan information they need as part of the process. (5%)
11. This position manages the inventory and safekeeping of all legal plan documents including plan amendments and restatements as required following actions by the Management Committee for Employee Benefits or the Administrative Committee to ensure that all plan documentation is up-to-date and organized and can be retrieved in an easy manner. This position also manages the electronic storage of all applicable compliance documentation. (5%)
12. This position manages other retirement data error reports and projects as assigned. (5%)
Relationships (Internal and External)
In this section, describe all internal and external clients of position, as well as the frequency of interaction.
Internal:
• This position will assist with activities of the Benefits Compliance function and continually interface with all areas of the Benefits Function to ensure compliance strategies are fully integrated in the administration of the benefit plans
• This position reports directly to the Manager, NA Retirement Plans
• This position works directly with the Benefit/Plan Managers, as applicable.
• This position works with Benefits Legal Counsel
• This position works with other internal departments as needed including Internal Audit, Human Resources & Finance, Treasury and individual locations
External:
• This position works with a number of service providers and will be responsible for managing those relationships from a compliance perspective.
• This position works with an outside fulfillment vendor in terms of coordinating the distribution of benefits compliance related documents – notices, SPDs, etc.
• This position may also work indirectly with outside Benefits Legal Counsel

5. Strong Communication Skills – Excellent written and oral communication skills including highly effective Interpersonal and consulting skills while working with all levels of the organization and the ability to Explain complex compliance requirements in an understandable manner
6. Strong Technical Skills – Displays broad knowledge and understanding of benefits compliance and an awareness of the impact that compliance has on other areas of the Benefits Function including Finance, Administration, Strategy and Communications.
