Job description

The Manager, Legal Affairs, reporting to the Counsel for Merchant Financing (MFin), will provide a broad range of legal service to and serve as part of a support team for the MFin business. MFin is American Express' Small Business Lending team. The selected candidate will support the following client groups and will:
• Partnerships and Business Development Team: Draft, negotiate and review third party agreements with processors, online lenders and vendors as well as advise on compliance, contractual interpretation, and other issues relating to client programs; interact, liaise and follow up with support teams including privacy, fair lending, technology law and consumer practices; serve as General Counsel Organization point of contact for the Partnerships team.
• Marketing: Review marketing collateral and solicitation procedures created for MFin products for accuracy and compliance with existing financial and advertising regulations and laws, including but not limited to UDAP and the TCPA. The types of marketing collateral for review include but are not limited to: direct mail, email, teleservicing scripts, promotions, offers, and product fact sheets; serve as General Counsel Organization point of contact for the Marketing team.
• Credit Risk and Information Management: Support MFin Credit Risk Management Team in implementation of various initiatives related to underwriting, credit monitoring, prospecting and corporate bankruptcies. Review MFin agreements to ensure MFin Credit Management Risk team maintains flexibility to readily action credit decisions.
• Online and Product Development Team: Provide counsel and advice to Online Team in its development and deployment of new products. Advise MFin business contacts on Data Privacy and Information Security principles in the context of client discussions.

Desired profile

• Detail-oriented, with exceptional ability to manage multiple projects independently.
• Experience with drafting and negotiating commercial contracts.
• Ability to gain credibility, manage expectations, and develop strong working relationships with legal colleagues and business clients.
• Experience working “hands on” with clients and ability to convey clear advice as well as pro-active, creative, and business-oriented solutions.
• Ability to work well in cross-functional team settings.
• Excellent oral and communication skills.
• Ability to handle deadline-driven tasks, driving each to completion in a timely manner.
• A minimum of 3 years of relevant experience with emphasis on finance/contract law.
• Secured transactions and/or bankruptcy background is a plus.
• Strong work ethic and personal accountability.
• Must be competent with online research tools.
• High level of organizational skills.
• JD Preferred.
