Department Overview

The BNPP Real Estate UK (the entity) Compliance Department is responsible for ensuring that all activities conducted by the entity are conducted in compliance with all applicable laws, regulations and internal Group BNPP policies and procedures. In particular, the Compliance Department is responsible for implementing relevant Compliance Policies and Procedures, monitoring compliance with those Policies and Procedures, and providing compliance advice, guidance and challenge to all entity employees. The BNPP Real Estate (RE) Compliance Department forms part of the BNPP CIB UK Compliance Department.

The role

The Financial Security Compliance Officer role will form part of the UK BNP Paribas Real Estate (RE) Compliance Department and will report directly to the Head of Financial Security Compliance. However, the Financial Security Compliance Officer will have his/her day to day work allocated to them and checked by the Senior Financial Security Compliance Officer who will also report to the Head of Financial Security Compliance.

As part of the Financial Security team within BNPP RE Compliance, the Financial Security Compliance Officer will focus on 3 main areas:

• Provide advice, guidance and challenge to the Real Estate Businesses on Money Laundering and Terrorism Financing, Sanctions and Embargoes matters in relation to instructions (regulated & unregulated), customer on-boarding and other matters.
• Action in a prompt and complete manner all enquiries that come into the UK Compliance email inbox as well as telephone or face to face enquiries These enquiries will in particular relate to Client Acceptance Committee (CAC) forms, PEP escalations and Major Sanctioned Country alerts as well as customer and transaction screening alerts.
• Provide pro-active Conduct of Business regulatory support and advice in relation to all applicable estate agency business activities.

Key Deliverables

• Support the Senior Financial Security Compliance Officer and the Head of Financial Security in providing guidance, advice and challenge to the Business on the application of Compliance Policies, Procedures and processes in relation to Money Laundering and Terrorism Financing, Sanctions and Embargoes matters.
• Support the Senior Financial Security Compliance Officer in providing a prompt and complete response in relation to all enquiries that come into the UK Compliance email inbox as well as telephone or face to face enquiries These enquiries will in particular relate to Client Acceptance Committee (CAC) forms, PEP escalations and Major Sanctioned Country alerts as well as customer and transaction screening alerts.
• Provide the Business with guidance, advice and challenge around estate agency specific transactions and KYC issues, in particular where they involve joint agents, sub agents, intermediaries and partners.
• Provide the Business with guidance and advice in relation to all relevant rules and regulations, including but not limited to the UK Money Laundering Regulations, HMRC Guidance, RICS rules and regulations, the Estate Agents Act 1979 and Consumer Protection from Unfair Trading Regulations 2008.
• To apply a robust risk based approach when assessing CAC forms in order to arrive at a recommendation.
• To write clear and concise recommendations for CAC reviews based upon risk assessments;
• Conduct investigations into PEPs, Sanctions screening and Adverse News checks and refer to the Senior Financial Security Compliance Officer with a recommendation on the appropriate action.
• Conduct and document detailed, logical and conclusive PEP assessments.
• Conduct and document detailed, logical and conclusive Major Sanctioned Country alert assessments.
• Support the Senior Financial Security Compliance Officer in the review and assessment of Financial Security transactions and customer screening alerts.
• Support the Senior Financial Security Compliance Officer in the analysis and writing of SARs.
• Support the Head of Financial Security Compliance in providing pro-active guidance in relation to Conduct of Business issues as they relate to the RICS Code of Ethics, RICS Blue Book and RICS Purple Book.
• Support the Head of Financial Security Compliance in managing the Compliance review of Business related Marketing Materials.
• Support the Head of Financial Security Compliance in the delivery of face-to-face training to the Business on Money Laundering and Terrorism Financing, Sanctions and Embargoes and other property Compliance matters including Policies, Procedure and processes. A willingness to travel from time to time to the various branches across the UK to support the delivery of face-to-face training.
• Assist in the delivery of induction face-to-face training to new Business employees.
• Support the Senior Financial Security Compliance Officer and Head of Financial Security Compliance in the review and writing of UK specific Financial Security Policies and Procedures.
• Support the Senior Financial Security Compliance Officer and Head of Financial Security Compliance in implementing project specific deliverables.
• Escalate matters to the Senior Financial Security Compliance Officer and/or the Head of Financial Security when appropriate.
• Other ad-hoc duties as required.

Ideal candidate profile



Qualifications :

Person Specification:

• Previous experience working in a KYC/Customer on-boarding team within both the Real Estate and Banking sectors.
• Proven track-record of applying a risk based approach towards all customer enquiries and issues.
• Proven familiarity with KYC/on-boarding processes and systems within Banking and Real Estate.
• Proven track-record and knowledge of analysing different Real Estate customer and transaction types, in particular in relation to Legal entities, Wealth structures and Special Purpose Vehicles.
• Proven track record of analysing, clearing, and when required escalating, customer and transaction monitoring alerts.
• Proven track record writing logical and conclusive SARs.
• Ability to provide advice and guidance to the Business in terms of the application of KYC rules and requirements.
• To be able to apply a robust risk based forensic approach towards assessing customer Financial Security related matters.
• Proven experience of Real Estate / KYC analysis.
• Strong knowledge and understanding of Financial Security/AML risks in the real estate sector.
• Strong knowledge of all estate agency business rules and regulations, including but not limited to the UK Money Laundering Regulations, HMRC Guidance, RICS rules and regulations, the Estate Agents Act 1979 and Consumer Protection from Unfair Trading Regulations 2008.
• Proven track record of providing guidance in relation to Conduct of Business issues as they relate to the RICS Code of Ethics, RICS Blue Book and RICS Purple Book.
• Proven track record of conducting reviews of Business related Marketing Materials.
• Be familiar with all Compliance Policies, Procedures and processes and ensure knowledge is kept up-to-date.
